This latrine shortage has worsened during the lockdown during the pandemic, prompting the city council to make changes to the city's plumbing code. This change depended on the mayor's interpretation of what "public" means. Mayor Eric Adams' administration has decided that the change does not require businesses to open their restrooms to non-visitors.

Earlier this year, City Council member Rita Joseph introduced a bill that would require City Hall to offer at least one public toilet space per zip code by June 1, 2023.
