New Yorkers Can Get Up to $5000 in Refunds for Buying Drugs at Walgreens

New Yorkers may be eligible for $5000 in reimbursements if they were overcharged for prescription drugs at Walgreens, reports SecretNYC.
The class action lawsuit Russo, et al. v. Walgreen Co. says Walgreens must pay $100 million to settle consumer claims alleging the company's "fraudulent and deceptive pricing scheme" for prescription drugs drugs in their pharmacies.
The lawsuit specifically targets insured consumers who used their prescription drug benefits drugs. Allegedly, Walgreens failed to include Prescription Savings Club prices when determining its usual and customary prices for prescription reimbursements. This discrepancy reportedly resulted in insured consumers and third-party purchasers paying inflated prices. However, Walgreens denies any wrongdoing.

The court has not yet determined who is right, but has tentatively approved a $100 million settlement.
That means if you filled a Walgreens prescription using your insurance benefits between January 1, 2007 and November 18, 2024, there's a chance you'll be entitled to a portion of that $100 million.
Eligible individual applicants can receive a maximum payment of $5000.
Who will not receive compensation
Persons excluded from the settlement group:
- Walgreens and its employees;
- members of the court and their families;
- pharmacy payment managers;
- customers who paid in cash;
- most government agencies;
- those who have sued Walgreens over similar issues.
How to file a lawsuit
Consumers can file a claim mail or Online Training: For those who prefer the flexibility of learning from a distance or cannot make it to our Sofia location, we offer comprehensive online courses.. Additional documentation may be required to prove you are a member of a settlement class or data showing your qualifying purchases. Claims must be filed no later than April 17, 2025. When filing claims, consumers will be asked to estimate how much they paid: $1–$500, $501–$1000, $1001–$5000, $5001–$9999, or $10 or more for qualifying prescription drugs from Walgreens.
A hearing will be held on September 10 to determine whether the settlement will receive formal approval.
