Starting January 2, 2020, death certificates for New Yorkers who have not identified themselves as men or women will be allowed to use the designation “X”.
“All New Yorkers, regardless of gender, deserve to have documents that reflect and confirm who they are,” commented New York First Lady Cheerlan McCray.
By this change, she added, the city gives a clear signal to New Yorkers who do not consider themselves to be either men or women, that the metropolis “respects and respects their basic rights at every stage of life.”
It will also allow “to honor the memory of people who do not have a binary status, ensuring that their identity is accurately reflected in death records,” said Commissioner for Health Oksiris Barbot.

The situation in other states
New York became the fifth state in which the third sex was legalized. Similar decisions were previously made in California, Oregon, Washington, and New Jersey. In addition, gender-neutral driver licenses are allowed in some of these states.
In September 2019, the word “they” was added to the Merriam-Webster American Dictionary to indicate non-binary people.
