Restaurants in New York massively break the law and take extra money from you: what you need to know about your rights

If you have recently been to a restaurant and seen this, or perhaps did it yourself, then the restaurant has broken the law. This is an additional fee for paying by credit card. “New York businesses need to display accurate prices. A business may offer a discount if consumers pay in cash, but cannot charge an additional fee at the checkout simply because the consumer uses their credit card,” said Rossana Rosado, who oversees the New York State Division of Consumer Advocacy.

Here are two examples of violations you may encounter:

• Percentage fee: Tabitha goes to a cafe for lunch. She sees a sign on the menu that says, “If you use a credit or debit card, you will be charged a 5% fee.”
• Fixed Fee Notice: Kevin goes to his corner store for groceries. A sign at the checkout reads: "$5 fee for paying by credit or debit card."
